SMM Industries Pty Ltd (ABN 22 647 662 511), trading as SMM Industries, respects your privacy. This policy explains how we handle the personal information you give us, whether that is through our website, over the phone, or during a project.
As a small business we are not legally required to comply with the Privacy Act 1988 (Cth). We follow the Australian Privacy Principles as our own standard anyway, because we think you should know what happens to your details.
• Your name
• Your phone number and email address
• The suburb your project is in
• The type of project and roughly when you want to start
• Anything else you choose to tell us in the message box
• Your property address and details about the site
• Plans, drawings, approvals and council documents
• Contract, invoicing and payment details
• Correspondence between us during the project
• Your IP address, browser and device type
• Which pages you looked at and how you arrived at the site
• Information collected by cookies and similar technologies, described further below
We do not ask for and do not want sensitive information such as health, financial account details or government identifiers through the website form. Please do not send those to us that way.
• To respond to your enquiry and talk to you about your project
• To prepare quotes, contracts and programs
• To carry out building work and manage the project
• To meet our legal obligations, including licensing, insurance and home warranty requirements
• To send you marketing communications, if you have agreed to receive them
• To understand how our website and advertising are performing, so we can improve them
If you do not give us the information we ask for, we may not be able to answer your enquiry or provide a quote.
If you enquire with us, we may send you emails or text messages about our work and services. You can stop these at any time.
• Every marketing email has an unsubscribe link at the bottom
• Every marketing text message tells you how to opt out
• You can also email us at smmindustries@outlook.com and ask to be removed
We will action the request promptly. We will still contact you about a live project or an enquiry you have made, because that is not marketing.
We do not sell your personal information. We share it only where we need to, with:
• Our software providers. Our customer management system, email and text message delivery, website hosting and analytics providers store information on our behalf.
• Advertising platforms. Meta and Google receive information about website activity through the tracking tools described below.
• Trades, suppliers and consultants working on your project, where they need your details to do their job.
• Insurers, brokers and certifiers, where required for home warranty insurance, approvals or certification.
• Professional advisers such as our accountant or lawyer.
• Government bodies or regulators, where the law requires it.
Information sent overseas
Some of the software we use stores information on servers outside Australia, including in the United States. Where that happens, we take reasonable steps to make sure the provider handles your information consistently with the Australian Privacy Principles. By providing your information you consent to it being stored and processed overseas on this basis.
Our website uses cookies and similar technologies to make the site work, to understand how people use it, and to measure our advertising.
• Necessary cookies make the site function, including the enquiry form.
• Analytics tells us which pages people visit and how they found us.
• Advertising tools, including the Meta pixel, let us measure whether our ads are working and show ads to people who have visited the site.
You can block or delete cookies in your browser settings. Some parts of the site may not work properly if you do. You can also manage ad preferences directly with Meta at facebook.com/adpreferences and Google at adssettings.google.com.
We take reasonable steps to protect your information from misuse, loss and unauthorised access. That includes password-protected systems, limiting who can see your details, and using reputable providers.
No system is completely secure. If a data breach happens that is likely to cause you serious harm, we will tell you promptly and explain what we are doing about it. We commit to that whether or not the law requires it of a business our size.
We keep your information for as long as we need it, and for as long as the law requires afterwards. How long that is depends on the type of record.
• Project records such as contracts, plans, approvals, certificates and project correspondence: at least 10 years from completion. In New South Wales a building action can be brought up to 10 years after the occupation certificate is issued, so we keep the records that would let us respond to one.
• Financial and tax records such as invoices and payments: at least 5 years, in line with our obligations to the Australian Taxation Office.
• Enquiries that do not go ahead: up to 2 years, in case you come back to us, then deleted.
You can ask us to delete your details earlier. We will do that unless we are required to keep them for one of the reasons above.
You can ask us what personal information we hold about you, and ask us to correct it if it is wrong. Email smmindustries@outlook.com and we will respond within a reasonable time, usually within 30 days.
There are limited situations where we may not be able to give you access, for example where it would unreasonably affect someone else’s privacy. If that happens we will explain why in writing.
If you think we have mishandled your personal information, contact us first at smmindustries@outlook.com. We will look into it and respond within a reasonable time.
If you are not satisfied with our response, general guidance on privacy rights is available from the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
We may update this policy from time to time. The current version is always on our website, with the date it was last updated at the top.
